Balearic Islands approves decree allowing sealing of illegal tourist rental properties
The Government of the Balearic Islands has approved the urgent decree-law on measures to facilitate access to housing in the various municipalities of the archipelago. This decree also includes an amendment to the Tourism Law "to strengthen the fight against illegal tourist holiday rentals and recover residential properties that are clandestinely used for tourism."
With the approval of this decree-law, the competent tourism inspection is granted the authority to take provisional measures to halt the illegal activity of tourist stays in homes offered illegally.
Thus, as part of the sanctioning procedure provided for in the Tourism Law, the temporary closure of the establishment or tourist-use residence is established as a new provisional measure.
The Balearic Government states that this is a "first step to correct the effects caused by Law 6/2017 regarding the marketing of tourist stays in homes, particularly in residential properties belonging to the horizontal property regime or multi-family buildings.”
All measures included in this decree will come into effect immediately upon their publication in the Official Gazette of the Balearic Islands (BOIB), which took place yesterday (Tuesday).
